Terms and Conditions - Gia Marie Art

2. Subject of the Contract

These Terms and Conditions govern the purchase of artworks, including originals, prints, and commissioned works, which can be purchased through our online shop or via email. They apply to all commercial transactions between the buyer and the provider, unless otherwise agreed in writing. "We" and "us" refer to Marie Packmohr or Gia Marie Art.

3. Conclusion of Contract

The contract for the purchase of artworks is concluded as soon as the buyer completes an order in the online shop and receives an order confirmation via email. For orders placed via email, the contract is concluded through our written confirmation of the order.

4. Prices and Shipping Costs

All prices listed on the website are in Euros and include statutory VAT. A detailed invoice is issued and included with the delivery. Shipping costs are calculated based on the size, weight, and delivery location of the artwork and are displayed during the ordering process. For international shipments, additional customs fees and import duties may apply and are to be borne by the buyer.

5. Payment Terms

Various payment methods are currently available, including:

  • PayPal
  • Credit Card (Visa, MasterCard)
  • Other payment options specified at the time of order completion

Payment is due immediately upon conclusion of the purchase contract. Partial payments are not possible. We reserve the right to change or expand the available payment methods.

6. Delivery and Shipping

Delivery is made within Germany, the European Union, and 14 additional international countries. Most shipments are sent within 14 days. The estimated delivery times are approximately:

  • Within Germany: 1 to 2 weeks
  • Within the European Union: 2 to 4 weeks
  • Internationally: 3 to 6 weeks

All shipments are insured. The exact delivery time depends on the destination. If an artwork cannot be delivered within the specified timeframes, we will inform you in advance.

7. Retention of Title and Copyrights

The artwork remains our property until full payment is received. All rights to the artwork, including copyright and reproduction rights, remain with the artist. The buyer does not acquire any rights to reproduce or commercially use the artwork.

8. Right of Withdrawal

9. Warranty and Liability

In the event of a defect in the artwork, each case will be examined individually. Depending on the outcome, refunds, repairs, or replacement deliveries may be offered. We are liable for damages occurring during transportation, as the shipment is insured.

11. Copyrights and Resale

Copyrights and all reproduction rights for the artworks remain with the artist. Resale of the artwork is permitted, but without the right to reproduce or commercially use the work.

12. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany applies. The place of jurisdiction for all disputes arising from the contractual relationship is Hamburg, Germany.

13. Dispute Resolution

We do not participate in dispute resolution procedures before a consumer arbitration board. However, we strive to resolve any disagreements directly with our customers.
